Two Moody Gift Card Terms and Conditions

Your acceptance, use or purchase of a Two Moody Gift Card, eGiftCard, Gift Certificate, Store Credit or other stored value product (collectively, "Gift Cards") indicates your acceptance of these Terms and Conditions. Except as otherwise provided by law, these Terms and Conditions apply to all Gift Cards, whether purchased at store locations, online, or received from third parties.
BY PURCHASING, ACCEPTING OR USING YOUR CARD, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS (INCLUDING THE CLASS ACTION AND JURY TRIAL WAIVERS BELOW). IF YOU DO NOT AGREE WITH THIS AGREEMENT, DO NOT PURCHASE, USE OR ACCEPT THE CARD.
IMPORTANT: THESE TERMS AND CONDITIONS CONTAIN A CLASS ACTION WAIVER AND JURY TRIAL WAIVER, AS DETAILED IN THE “LEGAL DISPUTES” SECTION, BELOW. PLEASE REVIEW THE “LEGAL DISPUTES” SECTION BEFORE PURCHASING, USING, OR ACCEPTING THE CARD.
- Except to the extent prohibited by law, Two Moody LLC reserves the right to change the terms of this Gift Card program at any time or to contract with another party to administer this program. Any changes or modifications to these terms of use, guidelines, or rules will be effective upon posting of revisions. The updated terms of use will replace the prior version and are applicable to any future disputes between the parties, regardless of when the disputed interactions arose.
- Except as otherwise stated below, Gift Cards can be used at any Two Moody store, kiosk, pop-up, and at twomoody.com.
- Both physical and digital Gift Cards cannot be refunded, returned, or canceled once purchased except to the extent required by law.
- Gift Cards have no expiration dates. Maintenance, dormancy or service fees do not apply to balances on Gift Cards.
- Hold your Gift Cards securely and write down your Gift Card number and PIN in a safe place. We are not responsible for unauthorized Gift Card use. Gift Cards that are lost or stolen will ONLY be replaced, up to the value remaining, with satisfactory proof of purchase AND the Gift Card number. Email info@twomoody.com in order to have a lost or stolen Gift Card replaced.
- Gift Cards are not redeemable or refundable for cash, except to the extent required by law.
- We reserve the right to prohibit the purchase of Gift Cards with other Gift Cards.
- From time to time, you may be awarded with or receive "rewards," "promotional gift cards", "credits", "vouchers",
"store credit", "Groupons" or similar physical or electronic gift cards (collectively, "Promotional Cards"). As a general matter, these Promotional Cards shall have the same terms and conditions as the Gift Cards described here, however, they may be subject to additional restrictions or exemptions as provided on the Promotional Cards themselves or any packaging or other written materials that accompany such Promotional Cards or any applicable law. - Purchase amounts that exceed the value of the tendered Gift Card will require an additional payment for the balance due.
- Merchandise purchased by a Two Moody Gift Card and returned will be subject to Two Moody’s Return Policy. If the merchandise is eligible for return and was originally purchased with a Gift Card, and the return is made within 15 days of purchase or receipt of item, the refund will be in the form of a new gift card or the refund amount will be returned to the Gift Card used to make the original payment. For returns made after 15 days of purchase or receipt of item, the refund will be in the form of store credit that can be used
at any Two Moody store, kiosk, pop-up, or online at twomoody.com. Merchandise purchased by store credit and returned will be subject to Two Moody’s Return Policy. If the merchandise is eligible for return and the return is made within 15 days of purchase or receipt of item, the refund will be in the form of a new store credit. Purchases made with a store merchandise credit can be returned at any Two Moody store, kiosk, pop-up, or online at twomoody.com. - Gift Cards purchased online are sent to the purchaser’s email address and/or the gift card recipient’s email address that was submitted during checkout. Two Moody is not responsible if the wrong email address was submitted during checkout. If you are sending a gift card to someone other than yourself, you acknowledge that you have permission to enter that person’s email address on twomoody.com and Two Moody’s systems.

Two Moody reserves the right to hold any order for a security review. If your order is affected, you will be notified via email within two business days.

Gift Cards will not be redeemed if the card number is invalid or cannot be identified within Two Moody’s systems.
- We reserve the right to restrict the redemption of more than $1,000 in Gift Card balances by one person in any 30-day period.
- Two Moody LLC is the issuer of all Gift Cards and is the sole obligor to cardholders. Two Moody LLC is organized and domiciled in the state of Maryland, and the purchase and sale of Gift Cards issued by Two Moody LLC shall be deemed to be in Maryland and shall be subject to the laws and regulations of Maryland.
- Gift Cards may not be resold without Two Moody’s express written authorization. A Gift Card is not valid and will not be honored, and Two Moody will not be liable for the value of the Gift Card, if the Gift Card is obtained from an unauthorized seller or reseller, including through any internet auction site.
- In the event that the Gift Card system may become temporarily inoperative, you may be unable to obtain information about the balance on your Gift Card and Gift Card transactions, or use your Gift Card to pay for purchases. Please notify us if you have any problems using your Gift Card. You agree that Two Moody LLC nor any of their affiliates is responsible for any interruption of service or the quality, safety, legality, or any other aspect of any goods or services purchased by you with your Gift Card or that the Gift Card will be free from any errors or other defects.
- Two Moody LLC may assign this agreement and the Gift Card Program without recourse at any time without notice. In the event of such assignment, Two Moody LLC will cease to be the card issuer and obligor, and the assignee will become the sole obligor to cardholders. The waiver by Two Moody LLC of any provision or violation of these terms and conditions will not operate or be construed as a modification of these terms and conditions or waiver of any other violation.
- You may be the holder of a Two Moody gift certificate. Two Moody gift cards are redeemable at any Two Moody store, kiosk, pop-up, or online at twomoody.com. Unlike other Gift Cards, Two Moody gift certificates can only be used online at twomoody.com. To obtain your balance on a Two Moody gift card or Two Moody gift certificate, please email info@twomoody.com.

Legal Disputes; Class Action Waiver; Jury Trial Waiver
PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION AND TO HAVE A TRIAL IN FRONT OF A JURY.
NO CLASS ACTIONS: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ITS RIGHT TO PARTICIPATE IN A CLASS OR COLLECTIVE ACTION AGAINST THE OTHER PARTY IN ANY DISPUTE OR PROCEEDING (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY). ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR PROCEEDING.WAIVER OF JURY TRIAL: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL RIGHTS THEY MAY HAVE (INCLUDING BUT NOT LIMITED TO, THEIR CONSTITUTIONAL OR STATUTORY RIGHT TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JURY) TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING FOR ANY DISPUTES WHATSOEVER BETWEEN THE PARTIES, INCLUDING BUT NOT LIMITED TO, DISPUTES IN ANY WAY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS OR THE RELATIONSHIP OF THE PARTIES (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY).
